Understanding OSHA PSM Penalties

Current penalty maximums, reduction factors, and what real PSM enforcement actions look like.

Willful

$16,131–$161,323

Issued when OSHA finds an employer knew of a hazard and made no effort to correct it, or acted with plain indifference to employee safety. PSM willful citations are common in cases with incomplete PHAs, missing MOC documentation, or repeated prior violations. No good faith reduction applies.

Repeat

up to $161,323

Issued when a substantially similar violation existed within the past 5 years. OSHA compares citations across any facility under the same corporate entity — a citation at a sister plant counts. PSM repeat citations are frequently pursued in multi-site chemical companies.

Serious

up to $16,131

The most common PSM citation type. Issued when there is a substantial probability the hazard could cause death or serious physical harm. OSHA uses a "gravity" multiplier based on actual probability and severity — the adjusted penalty may be well below the maximum, but willful and repeat multipliers can drive it back up.

Other-Than-Serious

up to $16,131

Rare in PSM enforcement. Reserved for violations that have a direct relationship to workplace safety but would not likely cause death or serious injury. PSM paperwork deficiencies sometimes fall here, but OSHA typically classifies incomplete PHA or MOC documentation as serious.

Failure to Abate

up to $16,131/day

Issued when a previously cited violation has not been corrected by the abatement deadline. FTA penalties accrue per day, making this the fastest path to catastrophic penalty exposure. A single serious citation left uncorrected for 30 days equals $483,930 in FTA penalties alone.
